The Meridiana Realtor Mercedes A220 Giveaway (the “Contest”) is sponsored by GR-M1, Ltd. (the “Contest Sponsor”). The Contest Sponsor will raffle off one (1) 2021 Mercedes A220 automobile (including any applicable sales tax) (the “Prize”), in accordance with these Contest rules. The Prize has an approximate retail value of $ $37,255. The Contest will run from January 1, 2021 through December 31, 2021 (“Contest Dates”). The winner will be responsible for reporting and paying any and all income taxes (an IRS Form 1099 may be issued by the Contest Sponsor) and other taxes associated with winning the Prize, and the winner of the Prize will also be responsible for paying any registration, licensing, and transfer fees associated with the Prize.
Any photos and videos used for marketing and advertising purposes that depict the Prize are representative of the Prize, but may not be the actual Prize. At the time of the transfer of title to the Prize from the Contest Sponsor to the winner of the Prize, the winner must add the Prize to the winner’s automobile insurance policy. The Contest Sponsor disclaims all risk with respect to the Prize as of the time possession of the Prize is delivered to the winner, with possession being deemed to have occurred at the time Contest Sponsor delivers the keys to the Prize to the winner.
To qualify for one (1) entry into the Contest, a participant must sell and close two (2) new homes within the Contest Sponsor’s Meridiana master-planned community to unaffiliated, third-party homebuyers during the Contest Dates. One additional entry into the Contest will be earned each time the participant sells and closes two (2) additional new homes within Meridiana to unaffiliated, third-party homebuyers during the Contest Dates. For example, if a participant sells eight (8) homes within Meridiana in accordance with the terms of this paragraph during the Contest Dates, the participant will earn four (4) entries into the Contest. There is no cap on the numer of entries a participant may earn. No purchase by the participant is necessary to enter or win. Odds of winning will be determined by the number of entries, and therefore the odds of winning cannot be determined in advance. Void where prohibited by law. As used in these rules, (i) a home shall be deemed to “close” or be deemed to have “closed” if the deed conveying the home from the homebuilder to the unaffiliated, third-party homebuyer has been recorded in the official records of the applicable county within the Contest Dates, (ii) the participant shall be deemed to have “sold” a new home if the participant is paid a sales commission in connection with the closing of the new home, and (iii) a home shall be deemed to be “new” only if the sale is for the initial sale of a new home from the Meridiana homebuilder who constructed the home to the initial, unaffiliated, third-party homebuyer. Resale homes are not new homes and do not qualify for the Contest. It is the participant’s responsibility to submit proof of a sale and closing of a new home to the Contest Sponsor, which proof shall in the form reasonably required by Contest Sponsor.
The winner will be chosen by random drawing and announced on January 3, 2022. The winner must be present at the drawing to win. The random method of drawing/selecting the winner shall be at the sole discretion of the Contest Sponsor. The location where the drawing will occur will be at 4003 Meridiana Parkway, Iowa Colony TX 77583, or another location designated by Contest Sponsor by written notice to each participant who has earned an entry. In order to be eligible to participate, a participant must: (i) be a real estate salesperson who is properly licensed and in good standing in the State of Texas under the applicable Texas law, (ii) be 18 years of age or older, and (iii) have a valid driver’s license. Contest Sponsor may require proof of eligibility and will have the right in its sole and absolute discretion to determine whether such proof is valid, with Contest Sponsor’s determination being final. The winner will be required to provide identification and proof of name and address at the drawing. The Contest Sponsor shall have the right and power to determine eligibility; to determine and declare the winner of each drawing; to decide the random method of determining the winners; and to decide any matters in dispute. All decisions of the Contest Sponsors shall be final. The winner must provide all information and sign all documents reasonably requested by Contest Sponsor to complete the transfer of the Prize to the winner. Contest Sponsor shall not be liable for winner’s delay in providing requested information or for delays by applicable governmental agencies in completing the transfer. Employees of the Contest Sponsor, employees and/or in-house sales people affiliated with any Meridiana homebuilder, and their immediate families and members of their households, are not eligible to participate in the Contest. If the winner first selected on January 3, 2022 is not present or deemed by Contest Sponsor to be ineligible, an alternate winner will be selected, and such process of selecting will continue until a valid winner who is present and eligible is selected.
Each participant and the winner agree to release, discharge, indemnify and hold harmless the Contest Sponsor and each of its respective officers, directors, employees, representatives, attorneys, affiliates, partners, managers, and agents from and against any claims, damages or liability resulting in whole or part, directly or indirectly, from acceptance, possession, misuse or use of the Prize or participation in the Contest.
By entering and participating in the Contest, the winner and each participant acknowledges that he or she has received and reviewed these rules and agrees to them.
